Terms of Service

1. Acceptance of Terms
By downloading, installing, or using the Workd mobile application ("App"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Workd is a free fitness application that allows users to import workouts from various sources including Instagram, TikTok, websites, and screenshots. The App provides workout tracking, progress monitoring, and social fitness experiences. Premium features are available through in-app purchases.
3. User Accounts and Apple Sign In
You may create an account using Apple Sign In or other authentication methods. By using Apple Sign In, you agree to Apple's terms and conditions. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You must be at least 13 years old to use the App.
4. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the App on Apple-branded products you own or control, as permitted by the App Store Terms. You may not copy, modify, reverse-engineer, or create derivative works except as permitted by law. Apple is a third-party beneficiary of these Terms and may enforce them.
5. Premium Subscriptions
Subscriptions are billed to your Apple ID and auto-renew unless cancelled at least 24 hours before period end. Manage/cancel in Settings → Apple ID → Subscriptions. Charges may occur within 24 hours before renewal. If offered, free trials convert to paid unless cancelled before the trial ends; unused trial portions are forfeited upon purchase. Prices may change; continued subscription after the effective date constitutes acceptance. Refunds are handled by Apple and applicable consumer laws.
5.1 Consumer Rights
Nothing in these Terms limits your non-waivable rights under applicable law (e.g., EU/EEA/UK consumer protections, Swiss mandatory law).
6. Cloud Sync & External Services
The App uses Apple's CloudKit to sync your data. Disabling iCloud stops sync. We rely on third-party networks/services and will use commercially reasonable efforts, but we are not responsible for outages beyond our control.
7. Acceptable Use
You agree not to use the App to: Violate any applicable laws or regulations; Infringe on the rights of others; Upload harmful, offensive, or inappropriate content; Attempt to gain unauthorized access to the App or other users' accounts; Use the App for commercial purposes without permission; Reverse engineer, decompile, or modify the App; Send spam or malware; Attempt to bypass technical measures; Use the App illegally.
8. Your Content & Rights
You retain ownership of content you upload. You grant us a worldwide, non-exclusive, royalty-free license to host, process, adapt, display, and distribute your content within the App to operate and improve the Service. You must have rights to the content you upload. We may remove content that violates these Terms or law.
9. Health & Safety
The App provides general fitness information and is not a medical device. Consult a physician before starting any exercise. Stop use if you feel unwell. Do not use while driving or operating machinery.
10. Apple App Store Compliance
These Terms are between you and Workd, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you.
10.1 Developer Support
Workd, not Apple, is responsible for maintenance and support of the App. For support, contact: support@workd.fit. Apple has no warranty or support obligation for the App.
11. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App and explains how we collect, use, and protect your information.
11.1 Account Deletion
Delete your account anytime: Settings → Account → Delete Account. Deletion is permanent subject to limited legal/fraud retention, as described in our Privacy Policy.
12. Intellectual Property
The App and its original content, features, and functionality are owned by Workd and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. The App's design, text, graphics, and software are the property of Workd.
13. Termination
We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.
14. Limitation of Liability
To the maximum extent permitted by law, Workd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, resulting from your use of the App.
15. Indemnification
You agree to indemnify and hold harmless Workd from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes through in-app notice and the effective date. Continued use of the App after changes constitutes acceptance of the new Terms.
17. Governing Law & Venue
These Terms are governed by Swiss law, excluding conflict-of-law rules. Courts of Zürich have exclusive jurisdiction, except where mandatory consumer-protection rules give you the right to bring claims in your domicile.
18. Export Control
You must comply with applicable export, re-export, and sanctions laws and represent you are not a prohibited party or in an embargoed jurisdiction.
19. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
